Non-EU companies trading, or about to start trading, wholesale gas or power in the EU must register with an EU regulator and appoint a representative in that country. We support you from the start: your German ACER code, the mandate under Article 9 of REMIT, and the regulator's correspondence.
Since REMIT was revised in 2024, a non-EU market participant needs a designated representative in the EU when all three of these apply. The representative must be established in the same member state as the regulator you register with, and both must be in place before your first reportable trade.

What the regulation requires from non-EU market participants registered with ACER.
Register with the national regulatory authority of the EU member state where you are active in the wholesale energy market. One registration applies across the entire EU.
Your designated representative must reside or be established in the same member state as the regulator you are registered with. For the Bundesnetzagentur, that is Germany.
The representative must be authorised to handle communication with the national regulator and ACER, including regulatory decisions and requests for information.
If any information in your registration changes, you must inform the national regulator immediately.

Under the Regulation on Energy Market Integrity and Transparency (REMIT), non-EU companies active in the European wholesale energy market must appoint a designated representative who resides or is organized in an EU Member State. This representative acts on your behalf for regulatory matters, including communication with national regulatory authorities and ACER.
All non-EU companies that are active in the European wholesale energy market must appoint a designated representative. This includes companies trading electricity, natural gas, and other energy commodities within the EU. The requirement applies regardless of the size of your operations.
Before your first transaction that must be reported to ACER. You register with the national regulatory authority of a member state where you will be active, in Germany the Bundesnetzagentur via CEREMP, and receive an ACER code. As a non-EU company you also designate a representative in that member state. We support both from the start.
Non-EU companies must register with the national regulatory authority in the EU Member State where your company is active in the wholesale energy market. You only need to register once, and your registration will apply across the entire EU. There is no need to register in multiple Member States.
